Terms of Service

By using GetYourSong ("Service"), you agree to these terms. Read them carefully.

1. Service description

GetYourSong is a music analysis tool that extracts musicological characteristics (genre, instrumentation, vocal style, production traits, rhythm, mood) from songs and generates AI-ready prompts and lyrics. The Service does not reproduce, distribute, or republish copyrighted recordings.

2. Acceptable use

You may use GetYourSong to:

• Analyze songs for educational, creative, or commercial purposes
• Generate original prompts and lyrics for your own music projects
• Use generated outputs in commercial work (you own what you create)

You may NOT use GetYourSong to:

• Reverse-engineer, scrape, or attempt to extract source code or AI prompts
• Resell access to the Service without written authorization
• Use the Service for illegal activity, harassment, hate speech, or to generate content that infringes third-party rights
• Bypass rate limits or attempt to access features outside your subscription tier
• Submit automated requests at a volume that disrupts service quality

3. Intellectual property

Your content: You own all original content you generate using the Service (lyrics, prompts, customizations). You grant us a limited license to process and store this content solely to provide the Service.

Our content: The Service itself, including software, design, brand, and underlying methods, remains our intellectual property. We grant you a limited, non-transferable license to use the Service per these terms.

Third-party songs: When you submit a song name and artist for analysis, you represent that you are doing so for legitimate fair-use purposes (research, criticism, education, transformative creation). You are responsible for any downstream use of the analysis output.

4. Subscription and billing

Paid subscriptions renew automatically at the end of each billing period (monthly or annual). You can cancel anytime from your account settings; cancellation takes effect at the end of the current period.

Pricing may change with 30 days' notice. Existing subscribers retain their current price for at least 12 months from any price change.

Refunds are governed by our Refund Policy.

5. Free tier limits

The free tier provides 3 lifetime analyses per account. Multiple accounts to circumvent free-tier limits are prohibited and may result in suspension.

6. Service availability

We aim for 99.5% uptime but cannot guarantee uninterrupted service. Scheduled maintenance is announced in advance. Outages caused by third-party providers (Anthropic, Vercel, Stripe) are outside our control. We do not provide credits for short outages.

7. AI-generated content disclaimer

Outputs are generated by AI and may contain errors, inaccuracies, or unexpected results. We do not warrant that any analysis is 100% factually correct. Confidence scores indicate our system's certainty — always verify before commercial use. You are responsible for the final use of any AI-generated content.

8. Account termination

We may suspend or terminate accounts that violate these terms, particularly for: fraud, abuse, illegal activity, or attempts to harm the Service or other users. We provide notice and an opportunity to remedy unless the violation is severe or ongoing.

You may close your account anytime. See our Privacy Policy for what happens to your data.

9. Limitation of liability

The Service is provided "as is" without warranties of any kind. To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or data loss. Our total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify GetYourSong against any claims arising from your use of the Service, your content, or violation of these terms.

11. Governing law

These terms are governed by the laws of Delaware, USA. Disputes will be resolved in the state or federal courts of Delaware, except where consumer protection laws of your jurisdiction apply.

12. Changes to terms

We may modify these terms occasionally. Material changes will be communicated via email at least 30 days before taking effect. Continued use after changes implies acceptance.
